1. Introduction
These Website Terms and Conditions (the “Terms”) govern access to and use of the website available at www.digitain.com, including its pages, content, features, contact forms, product information, documents, downloadable materials and related online functionalities (the “Website”).
The Website is operated by Digitain (MT) Limited (“Digitain MT”). References in these Terms to “Digitain”, “we”, “us”, or “our” mean Digitain MT, unless expressly stated otherwise.
By accessing or using the Website, you agree to comply with these Terms. If you do not agree with these Terms, you should not use the Website.
These Terms apply only to the use of the Website. They do not govern the supply of Digitain products or services to customers, unless expressly incorporated into a separate written agreement. Any commercial relationship, licence, software service, platform access, integration, support service, managed service, professional service, or other paid product or service provided by Digitain is subject to a separate written agreement between Digitain and the relevant customer.
2. Legal Information About Digitain

The Website is intended to provide general corporate, informational, marketing and business-to-business information about Digitain, its group entities, products, services, solutions, licences, certifications, events, news and contact channels.
Unless expressly stated otherwise, the Website does not constitute:
- a legally binding offer to provide products or services;
- a gambling, betting, gaming, payment, financial, legal, regulatory, tax, technical or
- professional advisory service;
- an invitation to participate in gambling or betting;
- a consumer-facing gambling platform;
- a guarantee that any product, service, licence, certification or functionality is available in any
- particular jurisdiction; or
- a replacement for a written agreement with Digitain.
All product and service information is provided for general informational purposes only. Availability, specifications, integrations, features, technical requirements, commercial terms, regulatory approvals and implementation details may vary by jurisdiction, customer, product, configuration and applicable law.
4. Eligibility and Regulatory Restrictions
The Website is intended for business users, prospective corporate customers, suppliers, business partners, professional visitors and other persons acting in a professional or commercial capacity.
You must not use the Website if your access or use would be unlawful under the laws applicable to you.
Certain Digitain products or services may be subject to gambling, gaming, betting, payment, financial crime, anti-money laundering, sanctions, export control, age restriction, licensing or other regulatory requirements. Access to information on the Website does not mean that any Digitain product or service is lawful, licensed, available, approved, or suitable for use in your jurisdiction.
Digitain does not offer gambling or betting services to minors through the Website. Any regulated product or service is subject to applicable legal, licensing, eligibility, age-verification and contractual requirements.
5. No Online Contract for Paid Services
The Website may allow you to submit enquiries, request information, request a demo, contact Digitain, register interest in products or services, subscribe to communications, or download materials.
Submitting a form, requesting a demo, contacting Digitain, subscribing to communications, or downloading materials does not create a contract for the supply of paid products or services and does not oblige Digitain to provide any product, service, demo, access, licence, offer, quotation, support, integration or other commercial arrangement.
Any contract for paid products or services will be formed only when the relevant parties enter into a separate written agreement signed or otherwise validly accepted by authorised representatives of the parties.
6. Consumer Rights
The Website is primarily intended for business-to-business and professional use.
If, despite this, you access or use the Website as a consumer in the European Union, the United Kingdom, Switzerland, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits or excludes any mandatory rights or remedies that cannot lawfully be limited or excluded.
Where Digitain offers any product or service to consumers through a distance or online contract, separate consumer terms, pre-contractual information, cancellation information, payment information and other legally required disclosures will be provided before the consumer is bound by the contract.
7. Changes to the Website
Digitain may update, modify, suspend, restrict or discontinue all or part of the Website at any time, including any content, product information, service descriptions, pages, functionalities, links, tools, materials, downloads or features.
We do not guarantee that the Website or any content on it will always be available, uninterrupted, error-free, secure, compatible with your device or browser, or free from inaccuracies.
8. Changes to These Terms
Digitain may update these Terms from time to time. The updated version will be published on the Website and will indicate the date on which it was last updated.
Where changes are material, we may take reasonable steps to bring them to users’ attention, for example by posting a notice on the Website. Your continued use of the Website after the updated Terms are published means that you agree to the updated Terms, unless mandatory applicable law requires a different legal mechanism.
9. Intellectual Property Rights
Unless otherwise stated, all rights, title and interest in and to the Website and its content are owned by or licensed to Digitain MT or the relevant rights holder. This includes trademarks, trade names, logos, product names, service names, domain names, text, graphics, icons, images, videos, designs, layouts, interfaces, software, databases, documents, reports, presentations, downloadable materials and other content.
You may view the Website and download or print extracts from it for your internal business evaluation and lawful informational purposes only.
You must not, without Digitain’s prior written consent:
- copy, reproduce, republish, upload, post, transmit, distribute, sell, license, modify, adapt, translate, reverse engineer, scrape, mine, extract, frame, mirror, or commercially exploit the Website or its content;
- remove or alter any copyright, trademark, proprietary, confidentiality or legal notices;
use Digitain’s trademarks, logos, branding, product names or materials in a way that suggests endorsement, partnership, authorisation, or affiliation where none exists; - use Website content to develop, train, improve, market or benchmark a competing product or service; or
- use automated tools, bots, crawlers, spiders, scraping tools or similar technologies to access, collect or extract Website content except where permitted by applicable law and not technically restricted by Digitain.
All rights not expressly granted in these Terms are reserved.
10. Licence to Use Website Materials
Where Digitain makes brochures, product sheets, white papers, presentations, reports, articles, images, videos or other materials available for download, Digitain grants you a limited, revocable, non-exclusive, non-transferable licence to use those materials for lawful internal business evaluation purposes only.
Such materials may not be amended, redistributed, republished, sold, sublicensed, used in misleading marketing, or presented as your own materials without Digitain’s prior written consent.
11. User Submissions
The Website may allow you to submit enquiries, forms, messages, business requests, comments, application materials, documents, files, feedback or other information (“User Submissions”).
You are responsible for ensuring that your User Submissions are accurate, lawful, appropriate, virus-free and do not infringe the rights of any third party.
You must not submit confidential, commercially sensitive, personal, regulated, special-category, criminal-offence-related, payment, authentication, government-issued identification, health, financial, or other sensitive information unless Digitain has expressly requested it through an appropriate secure channel and you are authorised to provide it.
By submitting User Submissions, you grant Digitain a limited right to use, store, review, process, transmit and respond to such User Submissions for the purposes of handling your request, communicating with you, evaluating a potential business relationship, complying with legal obligations, maintaining records, protecting rights, and managing Website security.
You represent that you have all rights and permissions necessary to provide the User Submissions and to grant the rights described in this section.

- use the Website in a manner that may damage Digitain’s reputation, systems, security, rights, commercial interests, customers, partners or users.
13. Illegal Content and Content Moderation
If the Website allows users to submit content or information that may be stored, displayed, transmitted or otherwise made available through the Website, Digitain may review, restrict, remove, disable access to, or refuse to process User Submissions where Digitain reasonably considers that they may be unlawful, infringing, misleading, harmful, abusive, technically unsafe, spam, fraudulent, irrelevant, or inconsistent with these Terms.
Where applicable law requires specific procedures for notices concerning illegal content, you may notify Digitain at info@digitain.com and provide:
- your name and contact details;
- the exact location of the content or conduct concerned;
- a clear explanation of why you consider the content or conduct to be unlawful;
- any supporting evidence reasonably available to you; and
- a statement confirming that your notice is accurate and submitted in good faith.
Digitain may take appropriate action based on such notice, including removing content, disabling access, restricting functionality, preserving evidence, contacting relevant users, or notifying competent authorities where required or permitted by law.
Nothing in this section requires Digitain to monitor the Website generally or to actively seek facts or circumstances indicating unlawful activity, except where required by applicable law.
14. Third-Party Websites and Resources
The Website may contain links to third-party websites, platforms, documents, social media pages, regulatory registers, certification bodies, partner websites, product pages, payment providers or other external resources.
Such links are provided for convenience and information only. Digitain does not control, endorse, guarantee, or accept responsibility for third-party websites, content, policies, security, availability, accuracy, legality, or practices.
Your use of third-party websites and resources is at your own risk and may be subject to separate terms, privacy notices, cookie notices and legal requirements.
15. Privacy and Cookies
Digitain processes personal data in accordance with its Privacy Policy and Cookies Policy, as updated from time to time and made available on the Website.
The Privacy Policy and Cookies Policy explain how personal data is collected, used, stored, shared and protected, including in connection with Website use, contact forms, analytics, marketing communications and cookies.
Accepting these Terms does not constitute consent to processing of personal data where consent is required by applicable data protection or ePrivacy laws. Where consent is required, Digitain will request it separately.
16. Accuracy of Information
Digitain uses reasonable efforts to keep Website information accurate and up to date. However, Website content is provided for general informational purposes only and may not always be complete, accurate, current, suitable for your needs, or applicable in your jurisdiction.
Digitain does not warrant or represent that:
- Website content is free from errors, omissions or inaccuracies;
- product descriptions are complete or reflect the latest version of any product or service;
- any product or service is available, lawful, licensed, certified or suitable in any particular jurisdiction;
- any technical description is sufficient for integration, procurement, regulatory, tax, accounting, operational or legal decision-making; or
- any Website content may be relied upon without separate verification and a written agreement.
You should obtain appropriate professional, technical, legal, regulatory, tax and commercial advice before making decisions based on Website content.
17. Licences, Certifications and Regulatory Information
The Website may refer to licences, approvals, certifications, registrations, memberships, awards or regulatory statuses held by Digitain or other entities specifically identified in the relevant information.
Such references are provided for general information only. They may apply only to specific entities, products, services, jurisdictions, activities, time periods or regulatory scopes.
Nothing on the Website should be interpreted as a representation that any product or service is licensed, authorised, certified, approved or available in every jurisdiction or for every customer.
Digitain may update, remove or amend licence, certification and regulatory information at any time to reflect changes in applicable law, regulator decisions, corporate structure, product scope or operational arrangements.
18. Security

You are responsible for using appropriate security measures when accessing the Website, including secure devices, updated browsers, antivirus protection, secure networks, strong passwords where applicable, and caution when opening links or downloading materials.
You must notify Digitain promptly if you become aware of any unauthorised access, security incident, vulnerability, misuse, suspicious communication or technical issue relating to the Website.
19. No Warranty
The Website and its content are provided on an “as is” and “as available” basis.
To the maximum extent permitted by applicable law, Digitain disclaims all warranties, representations and conditions, whether express, implied, statutory or otherwise, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, non-infringement, compatibility, security and uninterrupted access.
Nothing in these Terms excludes or limits any warranty, representation, right or remedy that cannot be excluded or limited under applicable law.
20. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, wilful misconduct, or any liability that cannot be excluded or limited under applicable law.

- your infringement of third-party rights; or
- your misuse of Website content.
This section does not apply to consumers where prohibited by mandatory applicable law.
22. Confidentiality
Information made publicly available on the Website is not confidential.
However, any non-public information disclosed by Digitain to you through secure portals, demos, commercial discussions, technical documentation, product testing, business communications, meetings or pre-contractual exchanges may be confidential and must not be disclosed or used except for the purpose for which it was provided.
Separate confidentiality or non-disclosure agreements may apply to demos, product evaluations, commercial discussions, integrations, technical materials or procurement processes.
23. Export Control, Sanctions and Compliance
You must not use the Website or any materials obtained from it in violation of applicable sanctions, export control, anti-bribery, anti-corruption, anti-money laundering, counter-terrorist financing, gambling, betting, gaming, payment, data protection, cybersecurity, intellectual property, consumer protection, or other applicable laws.
You must not submit enquiries or seek to obtain Digitain products or services if doing so would breach applicable sanctions, export controls, licensing restrictions, regulatory restrictions, or other legal requirements.
Digitain may refuse enquiries, restrict communications, suspend access, or decline business relationships where required or appropriate for legal, regulatory, risk management or compliance reasons.
24. Responsible Use of Regulated Products Information
The Website may contain information about products or services used in regulated sectors, including betting, gaming, risk management, fraud prevention, payment, CRM, affiliate, retail, data feed, platform and related technologies.
Such information is intended for professional and corporate audiences only.
Digitain does not encourage unlawful gambling, underage gambling, unlicensed betting activity, circumvention of regulatory controls, or use of regulated products outside applicable legal and licensing frameworks.
Any customer or business partner interested in regulated products or services is responsible for obtaining and maintaining all licences, approvals, permissions and controls required under applicable law, unless otherwise expressly agreed in writing.
25. Suspension or Restriction of Access

If you are a consumer, you may have the right to bring proceedings in the courts of your country of habitual residence or to benefit from other mandatory dispute resolution mechanisms available under applicable law.
28. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary to make it valid, lawful and enforceable. If that is not possible, the provision shall be deemed severed, and the remaining provisions shall continue in full force and effect.
29. No Waiver
Any failure or delay by Digitain to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
30. Assignment
You may not assign, transfer or otherwise dispose of your rights or obligations under these Terms without Digitain’s prior written consent.
Digitain may assign or transfer its rights and obligations under these Terms to an affiliate or successor in connection with a merger, restructuring, reorganisation, sale of business, transfer of assets, or similar transaction, provided that such transfer does not materially reduce any mandatory rights you may have under applicable law.
